Terms and Conditions
1. Introduction
These Terms and Conditions govern the provision of scaffolding services by East Coast Scaffolding Solutions Ltd (“we”, “us”, “our”). By accepting our quotation or instructing us to proceed with works, you (“the Client”) agree to be bound by these Terms and Conditions.
These terms apply to all domestic, commercial and industrial scaffolding services supplied by us across Edinburgh, East Lothian, Midlothian and surrounding areas.
2. Quotations
All quotations are provided free of charge and are valid for 30 days unless otherwise stated in writing. Quotations are based on the information provided at the time of survey or enquiry. We reserve the right to revise pricing where site conditions, access requirements, or scope of works differ from those originally advised.
Unless explicitly stated, quotations exclude:
- Local authority permits or pavement licences.
- Traffic management costs.
- Additional hire periods beyond the agreed duration.
- Out-of-hours or emergency works.
3. Acceptance of Works
Acceptance of our quotation, whether verbally, electronically, or in writing, constitutes a binding contract. We reserve the right to refuse or withdraw services where it is unsafe or impractical to proceed.
4. Client Responsibilities
The Client agrees to:
- Provide safe and clear access to the work area.
- Obtain any required neighbour permissions.
- Secure all necessary local authority licences unless agreed otherwise in writing.
- Inform us of underground services, fragile roofs, or structural concerns.
- Ensure no unauthorised persons interfere with the scaffold.
Failure to meet these responsibilities may result in delays or additional charges.
5. Health and Safety
All works are carried out in accordance with current UK health and safety legislation and industry best practice. Our operatives are appropriately trained and competent for the tasks undertaken.
We reserve the right to suspend or modify works where site conditions present a safety risk. Any additional safety measures required due to site-specific risks may incur additional costs.
6. Programme and Access
While we aim to meet agreed installation and dismantling dates, all schedules are subject to weather conditions, site readiness, and operational factors beyond our control.
The Client must provide reasonable notice for dismantling. If access is not available at the agreed time, additional hire and return visit charges may apply.
7. Hire Period
The standard hire period will be stated within the quotation. Continued use beyond this period will incur weekly hire charges at our prevailing rates.
Scaffolding remains our property at all times and must not be altered, moved, or tampered with by any third party.
8. Damage, Loss or Interference
The Client is responsible for the scaffold while it remains on site. Charges will apply for:
- Missing components.
- Damage caused by third parties.
- Unauthorised alterations.
- Vandalism where reasonable site security was not maintained.
We reserve the right to invoice for the full replacement or repair cost of any damaged or missing equipment.
9. Adverse Weather
The Client must ensure that all trades using the scaffold comply with weather safety guidance. We accept no liability for losses arising from high winds, storms, or extreme weather once the scaffold has been handed over, except where caused by our proven negligence.
10. Variations and Additional Works
Any changes to the agreed scope of works requested by the Client will be treated as a variation and may incur additional charges. We will endeavour to notify the Client in advance where reasonably practicable.
11. Payment Terms
Payment terms will be stated on the quotation or invoice. Unless otherwise agreed in writing:
- Domestic clients: payment due upon completion of erection.
- Commercial clients: payment due within 14 days of invoice.
We reserve the right to charge interest on overdue accounts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
We may suspend works or refuse dismantling where accounts remain unpaid.
12. Cancellation
If the Client cancels after acceptance of the quotation, we reserve the right to charge for:
- Materials ordered.
- Labour allocated.
- Administrative costs.
- Aborted delivery or erection visits.
Cancellations on the day of scheduled works may incur full charges.
13. Insurance and Liability
We maintain appropriate public liability insurance. However, we shall not be liable for:
- Pre-existing structural defects.
- Consequential or indirect losses.
- Delays caused by factors beyond our control.
- Misuse of the scaffold by third parties.
Nothing in these Terms limits liability for death or personal injury caused by our negligence where such limitation is prohibited by law.
14. Force Majeure
We shall not be liable for failure or delay in performing our obligations where caused by events beyond our reasonable control, including but not limited to extreme weather, acts of God, labour shortages, supply chain disruption, or government restrictions.
15. Complaints
We are committed to providing a professional service. Any concerns should be raised in writing as soon as reasonably possible so we can investigate and resolve the matter promptly.
16. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
